Constituent Assembly elections:

It is the right and the responsibility of Nepali people now at this point and time that we have historically reached the mandate from the people's movement II to accomplish "Constituent Assembly Elections." 

 It is people's mandate to decide whether we want to have republican state or the ceremonial monarchy.  But the past history has had scared us many times and now it tell us not to trust the Shah dynasty any more.

Therefore we must go ahead to abolish the entire underlying feudal oligarchic and autocratic government logistics by restructuring the whole state through new constitution of Nepal that can set the federal system government which will allow people to rule their districts as autonomous body of local government.

It is obvious that monarchy with its outdated values, primitive traditions that contradicts Vedic and Buddha's teachings, inhumanly scary superstitions that try to impose upon innocent Nepali people and the monarchy in the poorest county of the world in this 21st century cannot be survived.

There are only two ways for the monarchy to survive in this 21st century: One the monarchy must be very cleverly rich to invest its capital in the global economy and second the monarcy must be very radically secular, reach with thorough scientific observation, see the evolution of life from atom, elements, molecules and up to the work of DNA. 

Therefore see the importance of civil liberty and human rights in whole of humanity.  

The monarchy the insists on quality education to understand the scientific reality of existence.  Sees clearly like Buddha that religions, faith, believes, superstitions, rituals, rites and its gods, goddesses, temples, churches, monasteries are simply created by men. These are the work of mind of men who could only partially understand the unknown world around them. Thus to secure their future they clung with these imaginations for faith and belief, for superstition and traditions. 

 But the Nepali monarchy and its entire dynasty neither ever had such insight nor will have in the future. Since there values are primitive, irrational and unjust to 21st century's humanity it is time for Nepal to go ahead with the complete rights and responsibility given to people to rule their homeland themselves. This means the establishment of Democratic Republic of Nepal.

It is mandatory that people decide before the draft of a new constitution of Nepal by the members of elected national constituent assembly that people of Nepal mandate for Democratic Republic of Nepal or Democratic Kingdom of Nepal: 

To make this sure that it occurs in the political scenario of Nepal that people have right to decide whether they want the Republic or the Kingdom with ceremonial monarchy during the constituent assembly election the civil society, intellectuals, professionals and the political parties are responsible.

If the leaders are not vigilant at this point and time such opportunity will need another nationwide revolution to wipe the mentality of people with feudal oligarchic way of governance.

Such revolution will be brutal and violent in  frustration and anger of people who find themselves deceived by the lack of thinking and action of the leaders.

So far members of civil society, intellectuals, professionals, journalists are doing their job more thoughtfully than politicians in power both in cabinet and the Parliament for Democracy and civil liberty of people of Nepal.

Public awareness through protests, public gatherings, public movements are the democratic ways to make people feel the necessity of civil liberty in human existence.

The leaders, the intellectuals, the journalists, the head of the state who fail to make people fail to help realize the necessity of civil liberty in human existence are non but the selfish ignorant fool who get intoxicated with the power, glory and fame.

Therefore there lies not only political responsibility but also a great human or moral responsibility on the members of civil society, intellectuals, journalists, lawyers, politicians and so on in this juncture in Nepal that we succeed to establish complete democracy that must abolish the feudal oligarchic governance logistics or practice in administering the nation.

For example, the appointments of the secretaries in the government agencies or departments or ministries must have complete democratic logistics.

Any government appointments such as supreme court judges and attorney general must go through complete democratic procedures:

Candidates should be nominated by the cabinet or the government to bring to the Parliament for hearing.

After both lower and upper house hearings of the Parliament there should be voting in the both house for the appointment.

For a moment, if Shah monarchies and its dynasty had a rational and just way of monarchical life or practice, Nepal could have been formed as nation with the values and teachings of Buddha. The nation did not need to witness the loss of human noises and ears; nation did not need to witness the death of Bhimshen Thahpa; nation did not need to witness the Bhandarkhal; and in 21st century the nation did not to suffer the massacre of the educated king and his entire family! 

If such justice and rationality would exist in the Shah dynasties' blood there could have been questions how a single man could kill entire family members; how the none of the family member of the dictator king did not get killed in the family same gathering shooting; how come queen mother did not get killed; all in all how come those dead were rushed to be  cremated without national dignity and honor, and so on??? 

This is how Nepali people as human being question the entire history of Shah dynasty.  But the members of Shah dynasty and their puppets (feudal lords) still think Nepali people are Shah's subjects but not rational and thoughtful human being!

But people have not sacrificed their lives in the final showdown for nothing or for fun to make Shah happy! But to put stop in the continuance of monarchy who is thoughtless, superstitious,  brutal and tyrant.

Therefore constituent assembly elections are mandatory and people have right to decide what they really want - republic Nepal or ceremonial monarchy.

Then only the elected members of constituent assembly can decide to write the new constitution with the electoral mandate of the people of Nepal. That will be the constitution for the Democratic Republic of Nepal or the Democratic Kingdom of Nepal. 

Such complete democratic procedure must be applied to all government appointments for government agencies' and corporations' positions.

In the hearings of Parliament the members must thoroughly and honestly investigate the person's bio-data and personal background in terms of affiliations to political party, ideology and religion to make sure that he or she can do the job properly with respect to constitution of Nepal.

This means abolition of the centrally controlled government logistics of old regimes - feudal oligarchic and military autocratic government establishment of the Rana and Shah regimes. Examples such as...

End of the practice of government appointments without nomination and Parliament hearing procedures.

End of the practice of government appointments of district chief administrators (CDOS) with the establishment of the district administration cabinet by the elected district chair or govern from members of the elected district assembly members.

End of the practice of government appointments of district judge with the establishment of the district judge election by the popular vote of the people of each district.

End of the practice of government appointments of district attorney with the establishment of the district attorney election by the popular vote of the people of each district.

Elimination of the centrally controlled national law enforcement (police) government practice with the district level law enforcement government practice (police) through the election of the district law enforcement chief by the popular vote of the people of district  to manage district law enforcement practice and district police academy.

In federal system of government there should only be district law enforcement chief in seventy-five districts. 

   
District police chief and police personnel must be the permanent resident of the district. 

No law enforcement personnel can be diploid in a district with the residency of other district such as sending a police personnel from Kathmandu to run Jumla.

Such government practice must be unconstitutional as the practice of the old regimes - Rana and Shah.

There should never be a national law enforcement (police) chiefs like SP, ISP, SSP and so on to control centrally the law enforcement personnel in the whole country.

Therefore there should be district level of law enforcement responsibility to keep the law and order with district level of peace and security.    

 

Many of us will find this is very difficult to implement in the beginning. But we must not forget that we are accomplishing the mandate of complete democracy. Therefore it is the responsibility of members of civil society, intellectuals, lawyers, journalists, professionals and politicians to see the possibility of such restructure of the nation in complete decentralized federal system of governance.

We must not insist that "this does not work in our country, we are unique and need to carry on our traditional values". This will completely be irrational and thoughtless. We have to try with example of the success of the community forest and other local level of management which we learn from our foreign friends from developed nations.
